While the May 2026 Omnibus political agreement pushed back significant parts of the high-risk regime, the vast majority of the Article 50 transparency obligations remain on their original timeline.

On August 2, 2026, organizations must comply with almost all of Article 50, which includes:
- Article 50(1): Disclosing to users when they are interacting with an AI system (e.g., chatbots and virtual assistants).
- Article 50(3): Informing individuals when they are exposed to emotion recognition or biometric categorization systems.
- Article 50(4): Disclosing deepfakes and AI-generated text published on matters of public interest.
- Article 50(2): Ensuring machine-readable watermarking and detection for any new generative AI systems placed on the market after August 2.
The (only) exception:
The Omnibus agreement introduces only one narrow carve-out. It grants a short transition period until December 2, 2026, specifically for the Article 50(2) watermarking obligations, but only for generative AI systems that were already placed on the market or put into service before August 2, 2026.
For everything else, the August deadline stands.
Here’s why the timing is a practical challenge:
- May 8, 2026: Commission published the draft Article 50 guidelines.
- June 3, 2026: Public consultation closed.
- August 2, 2026: Most transparency obligations apply.
Final guidelines on how to implement these rules are expected to land only weeks or days before they become legally enforceable.
For many organizations, this is not just a paperwork exercise. Meeting these deadlines requires:
- Reviewing and mapping AI-enabled customer touchpoints.
- Designing and implementing clear disclosure mechanisms (Article 50(5) UX requirements).
- Integrating technical watermarking into synthetic content workflows.
- Updating internal policies, training, and vendor agreements.
While the wider conversation has focused on delayed high-risk deadlines, the immediate operational hurdle for most enterprises is transparency.
